The Geneva-based observatory stated in a letter posted on its website that "Israeli military attacks have resulted in unprecedented civilian casualties, forcing the vast majority of Gaza's population to flee under deadly conditions, and almost completely destroying the infrastructure."

He pointed out that "the deliberate and ongoing deprivation of basic resources, the infliction of severe physical and psychological harm on citizens, and the implementation of measures aimed at preventing them from having children, (factors) meet the elements of the crime of genocide under international law."

The Euro-Mediterranean Human Rights Monitor added, "Despite the extent of the destruction and human losses in Gaza reaching the point of no return, there is a chance to prevent further death and destruction if the European Union chooses to act and take a decisive stance."

He pointed out that "on March 2, 2025, Israel imposed a comprehensive ban on the entry of all humanitarian aid and commercial goods into the Gaza Strip, depriving more than 2.3 million people, half of whom are children, of the basic necessities of life. On the 18th of the same month, Israeli forces resumed direct military operations, characterized by mass killings."

He considered that what is currently happening in Gaza is not merely a return to war, but rather an escalation of "genocide," with gross violations continuing even during the ceasefire, reflecting the insistence on implementing a systematic policy of genocide against the civilian population.

The Observatory called on the European Union to take "urgent and decisive measures," including imposing economic, diplomatic, and military sanctions on Israel, suspending the EU-Israel Association Agreement, completely halting arms exports to Israel, and activating international accountability mechanisms.

He also urged EU member states to support efforts to hold Israeli officials accountable and to resort to the principle of universal jurisdiction to prosecute Israelis involved in war crimes and crimes against humanity against Palestinians in Gaza.

On November 21, 2024, the International Criminal Court issued two arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant for committing war crimes and crimes against humanity against Palestinians.
