Now there will be 3 years jail for taking fake SIM card, fine up to Rs 50 lakh India
New Delhi : The government is going to crack down on fraud through fake SIM cards and other similar crimes in the country. Telecom Bill 2023 has been passed in both houses of Parliament. In this bill, there is a provision of 3 years in jail and a fine of up to Rs 50 lakh for purchasing a fake SIM. After the President signs this bill, it will become law.
The new Telecommunication Bill 2023 was passed in the Lok Sabha yesterday and today it also got the green signal in the Rajya Sabha. This bill allows the government to take over, manage or suspend any telecom service or network for national security reasons. If necessary for public safety, the government will be able to intercept messages on the telecom network. Along with this, there is a provision of 3 years in jail and a fine of up to Rs 50 lakh for purchasing a fake SIM.
The new Telecommunication Bill will replace the 138-year-old Indian Telegraph Act. The Indian Telegraph Act currently controls the telecom sector. This bill will also replace The Indian Wireless Telegraph Act 1933 and Telegraph Wires Act 1950. Besides, this bill will also amend the TRAI Act 1997.
In this bill, telecom companies have been asked to compulsorily do biometric identification before issuing SIM cards to consumers. There is also a provision in the bill for 3 years in jail and a fine of up to Rs 50 lakh for purchasing a fake SIM.
In this bill, over-the-top services (OTT platforms) such as e-commerce, online messaging have been excluded from the definition of telecom services. Last year, when the draft of the Telecommunication Bill was presented, OTT services were also included in it, due to which there was a lot of uproar. Later the government removed it from the bill.
This bill will also bring changes in the licensing system. At present, service providers have to obtain different licenses for different types of services. But once this bill becomes law, there will be uniformity in licensing.
There is also a provision in the new Telecom Bill that consumers will have to take their consent before sending advertisements and promotional messages for goods and services. The company providing telecom services will have to create an online mechanism, so that users can lodge their complaints online. There is a provision in this bill for administrative allocation of telecom spectrum, which will speed up the launch of services.
It has also been proposed in the bill that the government should be given the authority to allocate satellite spectrum administratively. Till now, telecom companies have participated in the auction and submitted bids to win the spectrum.
Critics of the law have alleged that this bill will reduce TRAI to a mere rubber stamp, as this bill weakens the powers of the regulator to a great extent. The bill also has a provision to allow appointment of private sector corporate executives for the role of TRAI chairman. This provision may start a debate.
The new bill will benefit foreign companies like American businessman Elon Musk's Starlink. However, Jio may suffer loss due to this.
